Police Recommendations:- from Mr.C. D. Ulavekar, Assistant Commissioner of Police,
On the basis of your Honour’s order, I have carried out detailed parallel investigation in Khar Police Station’s C. R. No. 14/2008 under Section 354, 506(2) of I.P.C. and C. R. No. 17/2008 under Section 354, 509 of I.P.C.and given my opinion in Conclusions and Defects above. Apart from it I am suggesting my recommendations to your Honour as under.
1. Accused Dr. Vijay Sharma be acquitted from Khar Police Station’s C. R. No. 14/2008 under Section 354, 506(2) of I.P.C. and C. R. No. 17/2008 under Section 354, 509 of I.P.C.
2. In Khar Police Station’s C. R. No. 14/2008 under Section 354, 506(2) of I.P.C. and C. R. No. 17/2008 under Section 354, 509 of I.P.C., it is seen that following police officers are at fault and have acted in irresponsible and careless manner.
a) PI Tungare recorded panchanama in C. R. No. 14/2008 under sections 354, 506(2) of I.P.C. for seizure of weapon police station. He also got typed statements of witnesses Miss Rupa Waghmare and Miss Mashhuda Tungekar at the police station in their absence. Similarly, while recording panchanama for seizure of weapon, though complainant Sheetal Bansod was not present at the place of occurrence, it has been falsely mentioned that she showed the place of occurrence. Also, that the time of seizure of weapon, Kumari Rupali, Milind Waghmare, Miss Mashhuda Iqbal Tungekar, Dr. Vandana Vijay Sharma and Arpit Ashwinikumar Bansal were present in the clinic but their names have not been mentioned in the panchanama. Thus, it is seen that Inspector of Police Shri Nishikant Vishwanath Tungare has recorded a false panchanama.
3. Pursuant to my thorough parallel investigation, I recommend that necessary legal action be taken against 1)PI NIshikant Viswanath Tungare, 2)PSI Bhat, 3)PSI Shashikant Sawant and 4)PSI Mahadeo Koli.
