In respect of foreign travel medical insurance, is it obligatory that even at the inception of the contract that there should be mutual agreement for settlement on cashless basis? Is it not expected in all foreign travel mediclaim policies the insurer undertakes to directly pay the hospital on cashless basis in foreign currency in respect of a policy issued in Indian soil? Is there any case law on this issue? whether a consumer forum in India can insist that a claim against insurer for deficiency could be insisted only upon payment of the hospital charges by the patient / insured to the hospital before hand?
